GENERAL TERMS AND CONDITIONS FOR CONCERTS/EVENTS

Acceptance

By signing the booking form you are accepting the terms and conditions as outlined in this document. These terms and conditions can only be amended in writing by the dean or the administrator.

Accuracy

It is important that the organisers of events give the cathedral as much information as possible about the event at the time of booking.

Application

Must be made on the form provided and returned to the administrator. No contract is deemed to exist, nor may any advertising of the event or sale of tickets for it take place, until written confirmation and acceptance of the booking has been given by the administrator and received by the promoter.

Cancellation Policy

If the organisers cancel an event, for whatever reason, the booking deposit is forfeited. If an event is cancelled by the organisers within two weeks of the event then, in addition to the booking fee, an additional €200 is payable. If the organisers cancel an event within one week of the event, then the full amount becomes immediately payable.

Car Parking

The cathedral does not provide public car parking. This is in order to comply with fire regulations and to ensure access to the grounds for the emergency services. Disability parking for a few cars is available on the grounds.  PLEASE PROMOTE ON ALL ADVERTISMENTS AND TICKETS THAT PARKING IS NOT AVAILABLE ON THE CATHEDRAL GROUNDS.

Cathedral liability and in the event of a FUNERAL SERVICE

In the event of the cathedral cancelling an event, for whatever reason, then the cathedral is only liable for any amount that may actually have been paid to it. NOTE: A funeral service will take precedent over any concert booked in.

Equipment

The administrator will require advanced information about additional equipment, i.e. microphones, choir staging, etc, which are being brought into the cathedral and will agree times for the equipment to be set up.  The cathedral does not supply extension leads and has limited staging available for use. Evidence of PAT testing is required.

Final Plans

Must be agreed at least two weeks before the event, with the administrator.

Health and Safety

The administrator is responsible for compliance with health and safety legislation and is the designated health and safety officer for the cathedral. The administrator is aware of all emergency exits and procedures to be followed in the event of an emergency. Before the event starts, a safety announcement will be made by the administrator or other designated person.

COVID

All events must fully comply with the COVID-19 guidelines set down by the Department.

Insurance

The cathedral requires that it be covered to the extent of a minimum of €6,500,000.00 (six and a half million euro) for both employers and public liability. A copy of this liability insurance must be provided to the administrator in advance of the event. The hirer must check that anyone employed by the hirer, as a contractor for the event should have adequate insurance for both employers and public liability.

Liability

A. The users of the premises are required to comply with any requirements which may be communicated to them either verbally or in writing.

B. Rights are reserved in relation to the cancellation, by us, of any booking, without reason.

C. No liability is accepted for bodily injury to any persons or for loss or damage to any property brought into the premises.

D. RENTERS LIABILITY CLAUSE: Every letting shall be on the express condition, which is hereby made a condition precedent, that the hirers shall take out a policy or policies with an approved insurance company completely and comprehensively indemnifying the hirer and the Dean, Chapter and Select Vestry of the Cathedral Church of St Canice, Kilkenny and the Representative Church Body in respect of all claims by third parties or their personnel representatives or dependants under any statute or at common law for injuries loss damage to them or their property arising out of and in consequence of the use of the said premises or the said letting and whether caused by the negligence, breach of duty or breach of statutory duty of the hirers’ servants, agents or employees or the select vestry’s servants, agent or employees or otherwise howsoever.

Payment

The booking deposit of €350 is payable when the date of an event is confirmed. This is not refundable. The full balance is due within two weeks after the event.

Performers

All must provide their own music stands. Cellists and double bass players are requested to bring some form of protective covering so that the spikes do not damage the ceramic tiled floor.

Publicity

A proof/draft must be submitted to the Cathedral Administrator prior to printing and distribution. . Under no circumstances may any posters or leaflets be distributed in any place, which may give rise to an offence under the Litter Pollution Act 1997. The organisers of any event will be held liable in the event that the cathedral is prosecuted as a result of their actions, under the above or any other act.

Recordings

Permission for the making of any audio or video recording must be obtained in advance. Where these are for commercial use, additional fees may be payable to the cathedral. If any music performed is within copyright, the applicant must obtain and display a licence from the Mechanical-Copyright Protection Society (Ireland) Ltd., Copyright Agents, Lower Pembroke Street, Dublin 2.

Sale of Goods

Only items directly relating to the organisation e.g. tapes, CDs etc. may be sold during a concert and prior permission must be obtained from the administrator. The cathedral has the right to sell refreshments at the event.

Seating

Any alteration necessary in the existing seating plan must be discussed with the administrator.  Please note that the maximum seating is 550 seated in the nave and side aisles. The seating arrangement may have to be reduced if seats have to be removed to accommodate performers. *See COVID-19 guidelines*

Security

1. Doors

The cathedral is often used for several concurrent functions. It also employs a number of staff, many of whom may be at work while your function is taking place. For your safety, for the safety of the cathedral staff, and to safeguard your valuables, all doors must be kept closed (and therefore locked) at all times. NO door may be secured in the open position.

2. Valuables

If you have booked the Chapter Room as a Green Room for a cathedral concert, your valuables may be stored in this room for the duration of the concert. The cathedral does not accept responsibility for any items that go missing.

3. Access to the buildings

Please arrange for the person responsible for your event to meet with the duty sexton at the beginning of your event. You will then need to leave a member of your party to let the other members of your party in. Do not allow anyone else to enter the building, unless it is a member of the cathedral staff.

Smoking- Is not permitted anywhere in the cathedral environment.

SMOKE/FOG/WATERBASED HAZE MACHINES ARE NOT PERMITTED. Breach of this rule will result in the cancellation of the concert.

Stewards

If more than one hundred people are expected to attend an event, the organisers must, in order to comply with health and safety regulations, supply at least three stewards. These stewards are in addition to those who may be involved in selling tickets etc. at the door. The stewards are to arrive not later than 30 minutes for a pre-event brief.

Toilets

Toilets are available. Access to the toilets is via the north transept. Performers may use the toilet located in the robing room area. There is one gender-neutral toilet only in this area.

Use of Chapter Room

The Chapter Room may be hired (subject to availability) as a Green Room for a cathedral concert or as a rehearsal, recital or lecture venue. There is a piano. There are no changing facilities connected with this room thus, if it is booked as a Green Room, performers should arrive at the building already changed. If it is booked, every item of furniture MUST be returned to its original position. Groups may use the choir’s robing area as a Green Room, but must not interfere with the choir robes and music library. Instrument cases and valuables may be left neatly at the sides of the Chapter Room during a concert. As this is also the robing room for the clergy, all cupboard doors must be left clear. No food or drink may be consumed in the Chapter Room, unless by agreement. Under no circumstances is alcohol to be consumed anywhere in the cathedral buildings. Entry for performers or audience to the Chapter Room is via the main door of the cathedral (please see Security).

Use of Organ

If the organ is required for a concert, agreement of the organist must be sought. This can be done via the administrator.

It is understood that you will assist the duty sexton by helping to restore the cathedral and/or any rooms you have hired to its/their original order after a concert or event. Also please remember to take all your belongings away with you.

This Cathedral has been a place of Christian Worship for 800 years.  Please respect the building and refrain from the use of inappropriate language or anything which is of a blasphemous nature. The consumption of alcohol by performers is not acceptable in St Canice's Cathedral.   The above breaches will incur a penalty of €250 which will be donated to the Church of Ireland Bishops' Appeal for World Development.  The Cathedral reserves the right to refuse future performances to those who breach this code of behaviour
